The Society for the Propagation of the Faith, doing business as The Pontifical Mission Societies and hereinafter "MISSIO" is the developer and sponsor of this Website. MISSIO is a part of the worldwide Roman Catholic Church and is recognized as a charity under Section 501(c)(3) of the Internal Revenue Code pursuant to a group exemption ruling annually issued by the Internal Revenue Service to all Roman Catholic Institutions in the United States of America. The projects which have been placed on this Website are all sponsored by institutions that are a part of the worldwide Roman Catholic Church. (for example, local Churches, Religious Congregations of Men and Women, Seminaries, Catholic hospitals, Catholic schools, etc.).

All donors shall receive an acknowledgement of their contribution from MISSIO.

By accessing the MISSIO website or any related service or digital platforms, including the MISSIO USA chat bot the user or visitor ("You", "Your", "User" or "Users"), regardless of the type of media through which the User accesses MISSIO, agrees to these Terms of Use including to the Privacy Policy (together the "Terms of Use").

Users, who disagree with these Terms of Use or with any part of these Terms of Use, including the Privacy Policy, must not use this Service.

These Terms of Use are updated from time to time. MISSIO may do this at all times at its sole discretion and for a variety of reasons including to reflect changes in or requirements of applicable laws, new features or changes to its services. Users are, therefore, recommended to regularly check for the most recent version of the Service Terms of Use. If You continue using the Service after changes to the Terms of Use have become effective, You shall be deemed to have accepted those changes. PRIVACY

MISSIO takes your privacy seriously, and we believe you have the right to control your personal information. MISSIO uses industry-standard encryption technologies when transferring and receiving sensitive visitor data.

All donations are processed via third parties using secure servers. MISSIO is PCI-compliant, as are all third-party vendors used by MISSIO. More information about PCI compliance can be found on the PCI Security and Standards Council website.

Other basic information you might share with us, including but not limited to name, address, email, telephone number, and age, can be used to improve our website and marketing, and to keep you informed about our programs.

Things you do and information you provide

We collect the content and other information you provide when you use MISSIO, including when you sign up for an account, create or share, and message or communicate with others. This can include information in or about the content you provide, such as the location of a photo or the date a file was created. We also collect information about how you use our MISSIO, such as the types of content you view or engage with or the frequency and duration of your activities.

Things others do and information they provide

We also collect content and information that other people provide when they access MISSIO, including information about you, such as when they share a photo of you, send a message to you, or upload, sync or import your contact information.

Your networks and connections

We collect information about the people and groups you are connected to and how you interact with them, such as the people you communicate with the most or the groups you like to share with. We also collect contact information you provide if you upload, sync or import this information (such as an address book) from a device.

Device Information

We collect information from or about the computers, phones, or other devices where you install or access MISSIO, depending on the permissions you’ve granted. We may associate the information we collect from your different devices, which helps us provide consistent services across your devices. Here are some examples of the device information we collect:

  • Attributes such as the operating system, hardware version, device settings, file and software names and types, battery and signal strength, and device identifiers.
  • Device locations, including specific geographic locations, such as through GPS, Bluetooth, or WiFi signals.
  • Connection information such as the name of your mobile operator or ISP, browser type, language and time zone, mobile phone number and IP address.

Information from third-party partners

We receive information about you and your activities on and off MISSIO from third-party partners, such as in vendors, service providers and other partners.

We transfer information to vendors, service providers, and other partners who support our organization, such as providing technical infrastructure services, analyzing how MISSIO is used, providing customer service, facilitating payments, or conducting surveys. These partners must adhere to strict confidentiality obligations in a way that is consistent with this policy.

How do we use this information?

We are passionate about connecting MISSIO users to change-makers and communities around the globe who are making a difference in the lives of the poor and forgotten through direct, daily service. We use all of the information we have to help us provide and support the MISSIO platform. Here’s how:

Provide, improve and develop services

We are able to deliver our services, personalize content, and make suggestions for you by using this information to understand how you use and interact with MISSIO and the people or projects you’re connected to and interested in. We also use information we have to provide shortcuts and suggestions to you.

When we have location information, we use it to tailor our services for you and others, like helping you to find local groups or events or tell your friends that you are nearby.

We conduct surveys and research, test features in development, and analyze the information we have to evaluate and improve products and services, develop new products or features, and conduct audits and troubleshooting activities.

Communicate with you and those you know

We use your information and information you have shared with us (such as friends’ email addresses), to send marketing communications messages about MISSIO, MISSIO communities and projects and to let you and others know about our policies and terms. We also use your information to respond to MISSIO users when they contact us.

Making a donation

When you make a donation on MISSIO, we collect information such as your name, billing address, and email address, if you have not already provided these details. We collect information about your donation, including the project you are donating to and the amount of your donation. We also collect (but do not retain) credit card numbers which are processed by a third-party payment vendor subject to the Payment Card Industry Data Security Standards.

Project funding

Donors shall have the ability to designate their gifts to specific projects which are disclosed on the website. All funds designated for a particular project shall be distributed directly to the project. If a project is cancelled or removed from the website by MISSIO, all funds which have been designated for that project shall be directed to a general fund of support for the mission church and utilized at the discretion of MISSIO for other similar projects found on the website. All projects are sponsored by institutions which are part of the worldwide Roman Catholic Church and are supervised by the appropriate church official.

Each donation will be assessed a five (5%) percent fee which shall be used to support MISSIO’s website development and operation. This administrative fee will be paid to MISSIO and is also tax deductible by United States of America residents.

How long do we store data?

We store data for as long as it is necessary to provide products and services to you and others, including those described above. Information associated with your account will be kept until your account is deleted, unless we no longer need the data to provide products and services.

Security

MISSIO understands the importance of keeping your information secure and confidential. We have implemented policies and procedures designed to help safeguard your information.

Your rights in the content you submit

By posting Content to the Site you grant to MISSIO a non-exclusive, royalty-free, perpetual worldwide license to use, copy, transmit, translate, distribute and publicly display such Content and/or incorporate it into a collective work. You represent and warrant that (a) you have the right to grant the foregoing license; (b) the Content you post to the Site does not violate the privacy rights, publicity rights, copyright rights, intellectual property rights, or any other rights of any person.

Prohibition on obscenity

Any material you may submit to this website must not contain material which is sexually explicit, obscene, pornographic, violent, discriminatory, illegal (or portrays illegal activity), offensive, threatening, profane or harassing.

Copyright Policy

MISSIO respects the intellectual property rights of others and expects users of the Services to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your Content has been copied in a way that constitutes copyright infringement, please provide us with the following information: (i) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material; (iv) your contact information, including your address, telephone number, and an email address; (v) a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (vi) a statement that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

We reserve the right to remove Content alleged to be infringing without prior notice, at our sole discretion, and without liability to you.

Internet limitation of liability

If for any reason this Website is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of MISSIO which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Site, MISSIO reserves the right at its sole discretion, to cancel, terminate, modify or suspend the Website in whole or in part, at any time, without notice. MISSIO assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS Site IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MISSIO RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

TERMS OF USE

MISSIO is a crowd-funding platform for people and organizations to raise support for mission projects affiliated with the global Catholic Church.

These Terms and conditions govern MISSIO’S relationship with you when you use the MISSIO website, https://www.MISSIO.org/ ("Site"). MISSIO mobile app, any and all services available on or through the Site, or otherwise provided by MISSIO.

By using or accessing the Site and related services, whether manually or through automated means, you agree to these MISSIO Terms and conditions ("Terms"). These Terms apply to you if you are a fundraiser, charitable organization, donor, project leader, registrant or any other user of the Site and/or services (collectively, "users" or "you"). To be eligible to use the services and access the Site, you must: (1) be over the age of majority in the jurisdiction in which you live (i.e. at least 18, and in some cases 19) or, if you are a minor over the age of 13, you may only use the Site with the permission and supervision of your parent or legal guardian; (2) be registered with us (to the extent required) and not have been previously restricted, suspended or terminated by us; and (3) not be using another member’s account without her/his permission. Access to the Site and services from territories where the Site and/or services are illegal is strictly prohibited. Users are responsible for complying with all local rules, laws, and regulations regarding their use of the Site and services.

Overview

Our Role.. The purpose of our Site and services is to help individuals or organizations raise money for mission projects affiliated with a Catholic institution by providing a technology platform to allow fundraisers to connect with donors As such, we ask for a modest financing charge to cover the expenses related to operating the platform and to engage in ongoing education and training around MISSIO.

Becoming a Member. It is easy to become a member of our community by following the steps on the Site. You will be required to provide some information when you sign up, including an email address to receive any notices required by law, in lieu of communication by postal mail, along with other messages, including changes to features of the service.

User Names. You may need a username and password to use certain features of the Site and services and you may create certain URLs when you establish a profile or fundraiser. By selecting a user name and any particular URL you agree that you will not select or use a name or URL: (a) of another person with the intent to impersonate that person; (b) subject to the rights of any person without authorization; (c) in violation of the intellectual property rights of any person; or (d) that MISSIO, in its sole discretion, deems inappropriate or offensive. You hereby expressly permit MISSIO to identify you by your user name. You acknowledge and agree that you shall have no ownership or other property interest in your account, URL and/or user name, and you further acknowledge and agree that all rights in and to your user name and account are and shall forever be owned by and inure to the benefit of MISSIO. You are responsible for maintaining the confidentiality of your password and account, and are responsible for all activities (whether by you or by others) that occur under your password or account. You will notify MISSIO immediately of any unauthorized use of your password or account or any other breach of security. MISSIO assumes no liability for any loss or damage arising from any unauthorized use of your password or account by a third party. MISSIO has the right to reclaim any user names or URLs for any reason.

MISSIO may terminate or suspend a User's Account at any time and at its sole discretion without giving prior notice and without giving a reason for termination or suspension to the User. In particular, MISSIO will terminate or suspend a User's account, in case MISSIO discovers that the User has breached these Terms of Use. If circumstances so require, MISSIO reserves the right to resort to other actions as it deems appropriate in such situation, including bringing claims or court proceedings against the User.

User Comments. Certain parts of the MISSIO website offer the opportunity for users to post and exchange opinions, information, material and data (‘Comments’) in areas of the website. MISSIO does not screen, edit, publish or review Comments prior to their appearance on the website and Comments do not reflect the views or opinions of MISSIO its agents or affiliates. Comments reflect the view and opinion of the person who posts such view or opinion. To the extent permitted by applicable laws MISSIO shall not be responsible or liable for the Comments or for any loss cost, liability, damages or expenses caused and or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website. MISSIO reserves the right to monitor all Comments and to remove any Comments which it considers in its absolute discretion to be inappropriate, offensive or otherwise in breach of these Terms and Conditions.

Privacy. In addition to reviewing these Terms, you should also read our Privacy Policy to better comprehend how we collect and use your personal information. Your use of the Site and its services constitutes your agreement to our Privacy Policy.

Relationship of MISSIO. By using this Site you understand and agree that MISSIO shall not be responsible for any losses or damages incurred as a result of the fundraising campaigns or events. In the event of a dispute between users (including but not limited to fundraisers, donors, beneficiaries, and third parties), you hereby release MISSIO, its employees, agents, affiliates, directors, officers, representatives, subcontractors, advisors and volunteers from all claims, damages and demands that may or may not be known, suspected or related to such disputes about our service.

Additional Terms for MISSIO USA ChatBot Mass Program Participants

FOR THOSE WHO REQUEST MASSES

The custom of requesting a priest to offer Mass for someone or a specific intention, even when the person requesting the Mass cannot be physically present, is a longstanding tradition in the Catholic Church.

Mass stipends given through MISSIO help priests in need around the world with basic subsistence, including housing, food, clothing, medical care and transportation. Very often, priests use their Mass stipends for people in need in their parishes and to finance their pastoral activities. Each $10 Mass offering is allocated as follows:

  • $5 is offered directly to the priest who has committed to celebrating Mass for one special intention
  • $3.75 is allocated to a general fund of support for Religious Communities of men and women in support of their MISSIO projects
  • $1.25 is applied to costs associated with operating the platform
  • Any additional donation over the $10 offering is allocated to the general fund of support for Religious Communities of men and women in support of their MISSIO projects

MISSIO utilizes STRIPE for processing payments through its Facebook Messenger Chat Bot.

Offerings and donations made via the MISSIO USA Chat Bot for Mass intentions are not cancellable or refundable by those who request masses.

FOR PRIESTS

To qualify to participate in the MISSIO USA ChatBot Mass Program you must:

  • Be a priest in good standing with faculties to celebrate mass and be willing to follow ecclesial restrictions on the offering of masses and the reception of stipends
  • Agree to receive and respond to messages sent to you via the MISSIO USA Facebook Messenger Chatbot
  • Accept requests to offer a Mass for a specified intention
  • Choose a specific date and time for that Mass
  • Offer Mass on that date and time for that intention
  • Confirm that you have offered this Mass, fulfilling this Mass obligation

Additional Terms for Fundraisers

Any individual, entity or organization that registers as a member and raises funds through the Site ("fundraisers") is subject to the following additional Terms that apply specifically to fundraisers.

Any fundraiser may create or adopt a campaign and post that campaign to showcase and share certain information about the campaign and elicit financial contributions ("Donations") from other members (and non-members) by following the guidelines as shown on MISSIO platform.

If you create a fundraiser, you represent and warrant that you are the authorized representative of the Beneficiary with the authority: (i) to solicit donations for the Beneficiary; and (ii) to bind the Beneficiary to the Terms of this Agreement.

MISSIO reserves the right to reject any fundraiser without assigning any reason thereof. Any decision taken in this regard shall be final and binding, and not subject to any dispute or challenge.

You agree you will not upload post, email, transmit or otherwise make available any content or initiate communications which include information that you do not have the right to disclose or make available under any law or under contractual or fiduciary relationships. Upload, post, email, transmit or otherwise make available any content or initiate communication that infringes upon patents, trademarks, trade secrets, copyrights or other proprietary rights.

Any disclosure, notice, record or other type of information that is provided to you by us may be sent to you electronically by posting the information on MISSIO.org, or by sending it to you by e-mail. We will not be obligated to provide any communication to you in paper form. You agree to provide us with your current e-mail address for notices which we send to you.

Additional Terms for Donors

Any individual, entity or organization that registers as a member and donates funds through the Site or the services ("donor") is subject to the following additional Terms.

No Gift Restrictions. Donors are not permitted to impose restrictions on the use of donated funds by a Beneficiary. To the extent that a donation is made in response to an appeal for a particular program of a Beneficiary, or to the extent that a Donor purports to direct the use of donated funds by a Beneficiary, any such directions shall constitute non-binding recommendations only and the Beneficiary shall have full discretion to determine how all donated funds will be used.

Donor information. Donors shall provide MISSIO with such information as is required to enable the issuing of an official donation receipt.

Donor's Risk. All donations are at your own risk. Please make sure that when you donate to a given beneficiary, you understand how your money will be used. When donating, only donate to those entities to which you feel comfortable donating. MISSIO is not responsible for any misuse of the funds by the beneficiary.

Donor Commitments. By donating money through the Site, you represent and warrant that any donation you make is legal in your jurisdiction and that you are authorized to use the payment method you have selected.

General Terms

Ownership of the Site, Site information and services. The Site and services and all technology underlying the same are expressly owned and operated by MISSIO. Unless otherwise noted, the design and content features on the Site and services, including without limitation, information and other materials, illustrations, product layout and design, icons, navigational buttons, images, artwork, graphics, photography, text, data, audio sound, software, URLs, and the like, as well as the selection, assembly and arrangement thereof (collectively, the "Site Information"), are owned by MISSIO or its affiliates, if any, or are licensed by MISSIO from third parties. The Site and services, as a whole and in part, are protected by copyright, trademark, service mark, trade name, and other intellectual property and proprietary rights, and all other applicable rights are reserved.

The trademarks, logos, and service marks ("Marks") displayed on the Site are registered trademarks of their respective owners, are the property of their respective owners, and/or are protected by U.S. and international trademark laws and/or common law. Their uses are restricted to programs, events, products or services that MISSIO sponsors or with which we are otherwise affiliated. MISSIO's trademarks may not be used for personal financial gain. Use of the Marks is prohibited without MISSIO's express written consent except as permitted by applicable laws. Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use the Marks without MISSIO's express written consent.

No portion of the Site, services or Site Information may be reprinted, republished, modified, or distributed in any form without MISSIO's express written permission. You may not, and these Terms do not give you permission to, reproduce, reverse engineer, decompile, disassemble, modify, transmit, sell, distribute, license or create derivative works with respect to the Site, services or any of the Site Information.

You may not remove any copyright, trademark or other intellectual property or proprietary notice or legend contained on the Site, services, or the Site Information and you must retain all copyright, trademark, service mark and other proprietary notices contained on the Site, services or in the original Site Information on any authorized copy you make of the Site, services or the Site Information.

Feedback. You agree that submission of any ideas, suggestions, documents, and/or proposals to MISSIO through its contact or similar pages ("Feedback") is at your own risk and that MISSIO has no obligations (including without limitation obligations of confidentiality) with respect to such Feedback. You represent and warrant that you have all rights necessary to submit the Feedback. You hereby grant to MISSIO a fully paid, royalty-free, perpetual, irrevocable, worldwide, non-exclusive, and fully sublicensable right and license to use, reproduce, perform, display, distribute, adapt, modify, re-format, create derivative works of, and otherwise commercially or non-commercially exploit in any manner, any and all Feedback, and to sublicense the foregoing rights.

Use of Site. To the full extent permitted by law, the Site, services and the Site Information are provided "as is" with all faults. Your use of the Site, services, and the Site Information is at your own risk. The Site, services or Site Information may contain errors or omission, or may be out of date. The Site, services or Site Information may, without prior notice, change, be deleted or updated at any time. As a condition of your use of the service or the Site, you promise to:

  • Use the service in compliance with all laws, regulations, ordinances, directives, court orders and this Agreement local and applicable to your use of the Site and services;
  • Use the service so as not to damage, disable, overburden or impair the service, our networks or systems or not to interfere with any others’ legal rights or use or enjoyment of the service; and
  • Not engage in, or encourage, promote, facilitate or instruct others to engage in, activities which, in our judgment and discretion: (1) are illegal; (2) result in the infringement of the intellectual property rights of others or libel or defamation of another person; or (3) harvest or otherwise collect information about others (such as e-mail addresses or other personally identifiable information) without their consent.

Content. MISSIO shall have the right, but no obligation, to monitor User Generated Content and other features of the Site and services to determine compliance with these Terms and any other operating rules we establish. MISSIO shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted through the Site or services. We do not control any User Generated Content that you or other users may provide. MISSIO neither endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement on the User Generated Content, whether it is provided by MISSIO, our employees, or a third party.

Security of the Site. MISSIO maintains reasonable safeguards and personnel policies that are designed to guard the Site, the services, our systems and our volunteers', fundraisers', donors' and Charities' information. For example, for the security of your online visit to the Site, MISSIO may make use of firewall barriers, encryption techniques and/or authentication procedures. Unfortunately, no data transmission over the Internet can be guaranteed to be absolutely secure. As a result, while MISSIO strives to protect your information, it cannot ensure or warrant the security of any Content you transmit to us, and you do so at your own risk. In the event of a breach of the confidentiality or security of your personal information, MISSIO will notify you as necessary so you can take appropriate protective steps. Unless you indicate otherwise, we may notify you under such circumstances using the email address you provided to us when you registered with the Site.

Site is for Use in the United States. The Site is hosted in the United States and is intended for users located in the United States. If you are user of Site from outside of the U.S., by visiting the Site, using the services and/or providing MISSIO with any User Generated Content specifically or Content generally, you agree to comply with all federal, state and provincial laws governing the Site, the services, online conduct and acceptable Content and User Generated Content. You further agree to comply with all applicable laws regarding the transmission of data exported from the United States or the country in which you reside.

Miscellaneous Other Provisions

  • In the event that one or more portions of these Terms shall, for any reason, be held to be unenforceable, the remaining portion will remain in full force and effect.
  • The headings used throughout these Terms are solely for convenience of reference and are not to be used as an aid in the interpretation of these Terms.
  • If MISSIO fails to enforce any parts of these Terms, it will not be considered a waiver
  • These Terms make up the entire agreement between you and MISSIO regarding the Site and supersede any prior agreements.
  • These Terms do not confer any third party beneficiary rights.
  • You will not assign or transfer any of your rights or responsibilities under these Terms to anyone without MISSIO's express written permission.
  • MISSIO may, at any time, assign our rights or delegate our obligations hereunder without notice to you in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.
  • Nothing in these Terms shall prevent MISSIO from complying with the law.
  • MISSIO shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials.
  • MISSIO project leaders are prohibited from sharing their personal email accounts, social media Sites and or websites through the platform with members of the MISSIO community, donors and / or fundraisers. Failure to comply may result in being removed from the platform.

If your project is located in an OFAC-sanctioned* country, MISSIO cannot send money to or do business with these countries and people residing within these countries.

*OFAC is the Office of Foreign Asset Control and is a branch of the U.S. Treasury that enforces economic sanctions against various countries, individuals, economic institutions, and groups in order to enact U.S. foreign policy and security goals.
